Keith Bergelt is an American businessman and entrepreneur. He is the founder and CEO of Open Invention Network (OIN), a patent non-aggression community that enables innovation in Linux and adjacent open source technologies. He is also the founder and CEO of IP3, a global intellectual property strategy and management firm. Bergelt was born in New York City and grew up in the Bronx. He attended the Bronx High School of Science and graduated from the University of Pennsylvania with a degree in economics. He then attended the University of Virginia School of Law, where he earned his Juris Doctor degree. Bergelt began his career as a patent attorney at the law firm of Finnegan, Henderson, Farabow, Garrett & Dunner, LLP. He then served as the Chief Intellectual Property Counsel at IBM, where he was responsible for the company's patent and trademark portfolios. In 2005, Bergelt founded Open Invention Network (OIN), a patent non-aggression community that enables innovation in Linux and adjacent open source technologies. OIN has grown to become the largest patent non-aggression community in history, with more than 2,000 members. In 2011, Bergelt founded IP3, a global intellectual property strategy and management firm. IP3 provides strategic advice and services to companies, universities, and governments on intellectual property matters. Bergelt is a member of the American Bar Association, the American Intellectual Property Law Association, and the Licensing Executives Society. Bergelt holds degrees from Duke University’s Trinity College (AB), the Dedman School of Law at Southern Methodist University (JD), and Edhec Business School (Theseus MBA). In addition, he has studied management at INSEAD and Institut National des Telecommunications (INT) in France and economics and technology policy at University of San Francisco's McLaren Graduate School of Business.

Bergelt was then brought into Motorola Corporation in Schaumburg, IL to establish and serve as General Manager of its Strategic Intellectual Asset Management business unit focused on distilling value from Motorola’s intellectual property. In addition, he served as Director of Technology Strategy during his tenure at Motorola.

Following his experience at Motorola and coincident with the departure of Bob Galvin from the Motorola Board of Directors, he was recruited by Kelso & Company, the New York-based private equity firm, to manage IP strategy, business development and licensing for its IP-based portfolio company – Cambridge Display Technology (CDT) – in Cambridge, England.

'Bergelt has been the chief executive officer of Open Invention Network since 2008. He is responsible for defending the integrity of the Linux ecosystem. Previously, Bergelt had criticized Microsoft several times for its behavior towards the open source community. When Microsoft changed its behavior, embraced the open source community and signed the Open Invention Network cross license, Bergelt was pleased with the company.

He has also been interviewed by Linux.com at the 2008 LinuxWorld Expo.

Upon graduation from law school, he entered public service and held diplomatic postings at the UN in New York City and the American Embassy in Tokyo, Japan. During his 12-year public service career he also lived in San Francisco, California and Washington, D.C. He was a colleague and tennis partner of U.S. Treasury Secretary Tim Geithner during their time together at the American Embassy in Tokyo in the early 1990s.
